Welcome to the ATACZ website (“Site”). These Terms of Service (“Terms”) govern your access to and use of the Site, including any purchases made through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

 

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates applicable laws or regulations
  • For fraudulent, misleading, or unlawful activities
  • To transmit viruses, malware, or harmful code
  • To interfere with the security or functionality of the Site
  • To attempt unauthorized access to any part of the Site
  • To collect or use personal information of others without authorization

 

2. Intellectual Property

All content on the Site, including text, images, graphics, logos, designs, and software, is owned by or licensed to ATACZ and is protected by intellectual property laws. You may not copy, reproduce, distribute, or exploit any content without prior written consent from ATACZ.

4. Orders and Payments

All orders placed through the Site are subject to acceptance and availability. We reserve the right to refuse or cancel orders at our discretion, including in cases of suspected fraud, pricing errors, or inventory limitations.

Prices, shipping fees, taxes, and applicable charges are displayed at checkout. You are responsible for ensuring your order information is accurate.

 

5. Promotions and Offers

ATACZ may offer promotions, discounts, promotional codes, free shipping, or other offers from time to time (collectively, “Promotions”). All Promotions are offered at ATACZ’s discretion and are subject to availability, eligibility requirements, exclusions, and any additional terms disclosed at the time of the Promotion.

Unless expressly stated otherwise, Promotions:

  • Cannot be combined with other offers
  • Have no cash value
  • Are valid for a limited time only
  • May be modified, suspended, or withdrawn at any time without notice

Eligibility for Promotions, including free shipping, is determined at checkout. Promotional benefits apply only when all stated conditions are met at the time of purchase. Discounts or free shipping applied in error may be revoked prior to fulfilment.

Promotions do not alter or replace ATACZ’s standard policies regarding shipping, returns, refunds, or cancellations unless explicitly stated in writing.

 

6. Shipping

Shipping methods, destinations, processing times, and delivery estimates are described in our Shipping Policy, which is incorporated into these Terms by reference.

Delivery times are estimates only and are not guaranteed.

 

7. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Returns and Refund Policy, which is incorporated into these Terms by reference.

Key principles include:

  • Return and refund eligibility is subject to stated timeframes and conditions
  • Refunds may be issued to the original payment method or as merchandise credit, depending on timing and circumstances
  • Exchanges are offered instore only and subject to availability
  • Sale, discounted, promotional, and designated finalsale items are not eligible for return or exchange

 

8. Gift Card Terms & Conditions

  • These Gift Card Terms & Conditions ("Terms") apply to all ATACZ physical gift cards and electronic gift cards ("Gift Cards") purchased and used via atacz.com or at authorised ATACZ retail locations. These Terms are designed to be compliant with Canadian and U.S. consumer protection laws and are fully compatible with Shopify Gift Card functionality.
  • General
    • Gift Cards may be used only for the purchase of eligible merchandise available through ATACZ.
    • Gift Cards have no cash value and cannot be redeemed, exchanged, or refunded for cash, except where required by law.
    • Gift Cards are not credit or debit cards and cannot be reloaded once issued.

  • Purchase & Issuance

    • Gift Cards may be purchased online through the ATACZ Shopify store or at participating ATACZ retail locations.
    • Electronic Gift Cards are delivered via email to the recipient provided at checkout.
    • Physical Gift Cards are issued at retail locations or shipped when applicable.

  • Redemption

    • Gift Cards can be redeemed online at checkout on atacz.com or in ATACZ retail stores where accepted.
    • Gift Cards cannot be used to purchase other gift cards.
    • If the purchase amount exceeds the available Gift Card balance, the remaining balance must be paid using another accepted payment method.
    • Any unused balance will remain on the Gift Card and may be used toward future purchases.

  • Returns & Refunds

    • Gift Card purchases are final sale and non-refundable.
    • Merchandise purchased using a Gift Card may be eligible for return in accordance with ATACZ’s Return Policy, unless otherwise stated.
    • Approved refunds for purchases made using a Gift Card will be returned to the original Gift Card and not to cash or other payment methods.
    • If a transaction is partially paid by Gift Card and partially by another payment method, refunds are applied to the Gift Card first, up to the amount paid.

  • Promotional & Bonus Gift Cards

    • Bonus, promotional, or incentive Gift Cards (including those issued during special campaigns) may be subject to additional conditions, including:
      • Final sale status for qualifying transactions
      • Restrictions on returns or exchanges
      • Expiration or usage limits (where legally permitted.)
    • Where a purchase qualifies for a promotional Gift Card, the customer may be required to choose between participating in the promotion or retaining standard return eligibility.
    • All promotion-specific terms will be clearly communicated at the time of purchase.

  • Loss, Theft, or Unauthorized Use

    • Gift Cards should be treated like cash.
    • ATACZ is not responsible for lost, stolen, damaged, or unauthorized use of Gift Cards.
    • Gift Cards will not be replaced if lost, stolen, or used without authorization, except where required by law.

  • Expiry & Balance Information

    • Gift Cards do not expire and no maintenance or inactivity fees apply, unless otherwise permitted by applicable law.
    • Customers may check their Gift Card balance online or by contacting ATACZ Customer Care.

  • Legal Compliance (Canada & United States)

    • These Terms are intended to comply with applicable Canadian provincial consumer protection laws and U.S. federal and state regulations, including gift card expiry and refund requirements.
    • Where local laws impose additional rights or restrictions, those laws will prevail to the extent required.

 

9. Disclaimer of Warranties

The Site and its content, features, and functionality are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, ATACZ disclaims all warranties, express or implied, related to the operation of the Site.

This disclaimer does not apply to physical products purchased from ATACZ. Productrelated issues are governed by our Returns and Refund Policy.

 

10. Limitation of Liability

To the maximum extent permitted by law, ATACZ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products, except as required under applicable consumer protection laws.

 

11. Indemnification

You agree to indemnify and hold harmless ATACZ and its affiliates from any claims, liabilities, damages, or expenses arising from your violation of these Terms or misuse of the Site.

 

12. ThirdParty Services and Links

The Site may include links or integrations with thirdparty services (including payment providers, analytics, or logistics tools). ATACZ is not responsible for the content or practices of thirdparty services.

 

13. Governing Law

These Terms are governed by the laws of Canada, without regard to conflictoflaw principles. Applicable consumer protection laws in your jurisdiction may provide additional rights that cannot be waived.

 

14. Policy Hierarchy and Incorporation

These Terms incorporate by reference our Privacy Policy, Shipping Policy, Returns and Refund Policy, Gift Card Terms, and any additional terms disclosed at checkout.

In the event of a conflict, the policy specific to the applicable transaction shall govern.

 

15. ATACZ Warranty & After-Sales Policy

  • Warranty Coverage

At ATACZ, we are committed to creating products that are designed to last. We stand behind the quality of our craftsmanship and are dedicated to providing thoughtful after-sales support to ensure you continue to enjoy your ATACZ products.

All ATACZ products purchased through our official website, retail stores, pop-up stores, or authorized retailers are covered by a 12-month limited warranty from the original date of purchase.

This warranty covers manufacturing defects in materials and workmanship under normal use, including but not limited to:

    • Stitching defects
    • Functional zipper failures
    • Hardware failures caused by manufacturing defects
    • Material defects affecting the normal use of the product

If a manufacturing defect is confirmed during the warranty period, ATACZ will, at its discretion, repair the product, replace the defective component, or provide a replacement product where repair is not possible.

 

  • Warranty Exclusions

The limited warranty does not cover damage resulting from:

    • Normal wear and tear of non-replaceable components
    • Cosmetic scratches, dents, or signs of regular use
    • Accidental damage
    • Improper use, misuse, abuse, or negligence
    • Unauthorized repairs or modifications
    • Damage caused by chemicals, solvents, or improper cleaning
    • Fire, flooding, or other environmental causes
    • Theft or loss
    • Natural fading or aging of materials over time

Products purchased through unauthorized retailers, resale platforms, or auction websites are not covered under this warranty.

 

  • Warranty Claim

To submit a warranty or after-sales request, customers may visit one of our retail stores or contact our Customer Care team at helloatacz@atacz.com with:

    • The original proof of purchase, such as a receipt or order confirmation
    • Photos of the product and damaged area (for online pre-checking)
    • The ATACZ product and all affected or damaged components
    • A brief description of the issue

Our Customer Care team will assess the request and recommend the most appropriate solution, which may include repair, component replacement, or product replacement, where applicable.

If the issue falls outside our warranty coverage, any available repair or replacement options—and the associated costs—will be communicated to the customer before proceeding. Any return shipping costs will be the customer's responsibility.

 

  • Customer Care & After-Sales Support

We encourage repair and component replacement whenever possible to help extend the life of ATACZ products and reduce unnecessary waste.

Customers may visit any ATACZ direct-operated retail location, excluding airports and wholesale locations, or contact Customer Care by email for warranty and after-sales support.

Depending on the product condition, nature of the issue, and availability of parts, ATACZ may offer repair, component replacement, or other appropriate solutions.

 

  • Product Care & Safety

To help maintain product performance and extend the life of your ATACZ product, we recommend regularly checking attachment points, tether tabs, clips, and other hardware components for signs of wear or damage.

If a component shows significant wear or damage, we recommend replacing it before continued use.

Please follow any product-specific care instructions provided and use ATACZ products only as intended.

 

  • Product Disclaimer

ATACZ products are designed for everyday use within their intended purpose.

ATACZ is not liable for any loss or damage to personal belongings, electronic devices, clothing, or other property resulting from misuse, improper installation, accidental damage, or use outside the intended purpose of the product.

For phone accessories and device attachments, while our products are designed to provide secure attachment during normal use, ATACZ cannot guarantee absolute protection against drops, impacts, or other unforeseen incidents. Users should exercise reasonable care when using these products.

 

  • Changes to This Policy

ATACZ reserves the right to update or modify this Warranty & After-Sales Policy without prior notice. The version in effect at the time of the original purchase will apply to warranty claims.

 

16. Changes to These Terms

ATACZ may update these Terms from time to time. Changes will take effect once posted on the Site. Continued use of the Site constitutes acceptance of the updated Terms.
